Medical Malpractice

We want to trust that our doctors treat us the right way and give us the best care possible. They almost always do.  Unfortunately, they are human. Sometimes humans can make mistakes.

Sometimes doctors make mistakes, and a patient is injured or killed as a result.  If you or a family member have been hurt by a doctor’s mistake, the injury can be overwhelming.  It can be hard to know where to turn or what to do.  The laws of North Carolina give you the right to recover from your injury and be made whole by the person who harmed you.  You deserve a compassionate, respectful law firm that will help you be made whole and receive the justice you deserve.

Knott & Boyle brings broad experience to all types of medical malpractice cases.  We have tried and settled cases involving misdiagnosis, failure to diagnose, medical mistakes, medical negligence, leaving a knife, gauze pad, or other surgical item in a patient’s body, surgery mistakes, operating on the wrong arm or leg (like cutting the left leg instead of the right leg), accidentally cutting an organ or blood vessel during surgery, paralysis, amputation, improper anesthesia, mistake with the wrong type or the wrong dose of medication, infection, using the wrong equipment to prevent a fall, and birth complications.  Knott & Boyle works with expert medical consultants like doctors and nurses to determine if you have a claim and, if so, to help you recover what you are due and get the justice you deserve.

If you have been injured by a doctor or while you were in a hospital, nursing home, or other health care facility, contact Knott & Boyle today, and let us use our more than 90 years of experience to seek justice for you.

Automobile Accidents

There are more than 200,000 traffic accidents in North Carolina each year, and more than 100,000 persons injured.  Often a driver’s mistake causes these injuries.  If a negligent driver hurts you, you have the right to recover and be made whole for these injuries.

The negligent driver almost always has insurance. The insurance company is supposed to make you whole for your injury. The reason that people have car insurance is specifically to cover what they owe to fix these types of mistakes when they cause an accident. However, we all know that the insurance companies will try to give you as little as they can get away with. The insurance companies will lowball you because they get to keep all of the money that they don’t pay out. It’s you versus them, and they don’t want to give you much if anything. If you don’t have an experienced attorney who knows how to deal with the insurance company, you may not get made whole like you deserve.

Knott & Boyle can help you navigate the confusion that can follow an automobile accident.  It is usually very difficult to negotiate with large insurance companies. They have a huge team that will try to minimize your recovery, without regard to what you are entitled to. They aren’t interested in giving you a fair deal. They just want to give you as little as possible.  Don’t let the insurance companies bully you into taking less than what deserve.  If you have been hurt in a car accident, contact Knott & Boyle today and let us put our broad experience to work for you to recover all that you deserve.

Nursing Home Injury

Putting a loved one in a nursing home is a difficult decision. Do they really need to go? Will the people working there take care of your father or mother like you did? It gets so difficult to keep them at home, that you are forced to make the tough decision. You have to take care of your family and your life, but you want to ensure that your parents have a good life. You want to trust that your mother or father will get the care they deserve.

The staff at nursing homes have a difficult job. Often, a patient at a nursing home has many complicated medical conditions. In spite of your hesitation and the difficulty of the decision, you decide it is in the family’s best interest to send your mother or father to the nursing home. You rely on the staff to take care of them. You trust the staff.

Unfortunately, accidents happen at nursing homes. Sometimes the staff is too busy to notice that your mother missed her medicine. Maybe the staff gets frustrated because your father has Alzheimer’s, and they are just a bit too rough with him so he falls and breaks his hip. Sometimes staff member Sally thinks that staff member Jane was checking on your mother to prevent bedsores, but Jane thought Sally was doing it. Nobody was doing it. You know what happens next. It’s not always mean spirited or intentional, but mistakes are made. And your mother or father is injured by the nursing home’s mistake.

What can you do to hold the nursing home accountable for the harm their mistake caused your mother or father? Knott & Boyle has worked with many families over the years where a mistake by a nursing home has caused a serious injury or death to a family member. We have tried and settled nursing home cases involving injuries or death from mistakes with giving medicine, falls, dropping a patient, failing to monitor a patient, failing to properly respond to a medical conditions, bedsores, and general neglect.

If a mistake made by a nursing home has injured your loved one, contact Knott & Boyle today. We can put our more than 90 years of experience to work helping you get the help your family deserves.

Denied Or Undervalued Insurance Claims

If an insurance company is not treating you fairly, we can help you deal with an insurance bully and get what you deserve. We also handle claims against insurance companies who deal in bad faith with their customers.

People buy insurance coverage to protect against many things including:  homeowners, automobile, fire, liability, theft, life, disability and business interruption.  When you discover that you might have a claim to make on the insurance policy that you have been paying for, you must follow certain rules to make sure that you receive coverage and get treated fairly. It would be nice if your insurance company would just cover your claim like it should because you have paid it for that coverage. Unfortunately, dealing with your insurance company can be difficult, sometimes overwhelming.  If you do not do it right, the insurance company may deny or unfairly limit your claim and what you recover.

Your insurance company has certain obligations and owes you duties after you make a claim on your policy.  If the insurance company fails to honor its duties and obligations by not promptly paying you the fair amount for your loss, you can hold the insurance company liable for that failure.  Sometimes an insurance company’s actions amount to bad faith or unfair and deceptive trade practices. If that happens, you, as the policy holder, can get damages from the offending insurance company above and beyond the amount of the insurance policy. In other words, if the insurance company should have paid you $100,000 for a covered loss but refuses to do so in bad faith, you could have a claim against the insurance company for 3 times that amount, or $300,000.

We have decades of experience helping folks like you who unfortunately find themselves getting treated wrong by their insurance company. If you find yourself in this situation where your insurance company will not reasonably cover your insured loss due to water or wind damage, claims of fraud, theft, vandalism or arson, or pay on life, health and disability insurance, contact us to discuss your situation. The insurance company may be trying to bully you. We are not scared of the insurance company. Sometimes these big, faceless corporations think they can push you around because nobody is paying attention. We are paying attention. We can help you get the justice you deserve.

You need a legal team that knows how to get results. Knott & Boyle has a proven history of doing just that. We look forward to having the opportunity to help you.
